This paper explores how policy structure, institutions, and political climate impact the ability of the Surface Mining Control and Reclamation Act (SMCRA) to ensure the reclamation of surface coal mines. We conduct a policy review that traces the impacts of the three parts of SMCRA; Reclamation Standards, Reclamation Bonding Requirements, and the Abandoned Mine Land : Ryan M. Yonk, Josh T. Smith, Arthur R. Wardle. @article{osti_, title = {Reclamation of surface mined lands}, author = {}, abstractNote = {A detailed report has recently been published in which the whole subject of mine reclamation has been extensively reviewed and discussed. Part One deals with the technology of reclamation, in which the methods and procedures used have been illustrated by examples taken from the practice of.

(Editor’s Note: On Ap , the general permit for small noncoal surface mining operations (those operations where less than 2, tons of noncoal minerals are extracted by surface mining in a given year), became effective because of the operation of section 26(b) of the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. Coal mining operations (on both federal and private lands) are regulated by the Office of Surface Mining or federally approved state OSM offices under the Surface Mining Control and Reclamation Act of , 30 U.S.C. § et seq. Leasing of Minerals on State Lands.

Surface Coal Mining in Appalachia Mining operations are regulated under the Clean Water Act (CWA), including discharges of pollutants to streams from valley fills (CWA Section ) and the valley fill itself where the rock and dirt is placed in streams and wetlands (CWA Section ). There is regulation of coal mining in the USA by the US Department of the Interior’s Office of Surface Mining Reclamation and Enforcement under the Surface Mining Control and Reclamation Act The industry is required to have reclamation programs for mine sites bringing them to the approximate original contours with revegetation.

Surface mining comprises different practices À strip mining, open-pit mining and mountaintop-removal mining À and accounts for more than 80% of ore mined each year (Ramani, ).

Surface mining. Surface mining, including strip mining, open-pit mining and mountaintop removal mining, is a broad category of mining in which soil and rock overlying the mineral deposit (the overburden) are removed, in contrast to underground mining, in which the overlying rock is left in place, and the mineral is removed through shafts or tunnels.

Surface mining began in the mid-sixteenth century [dubious. The Surface Mining Control and Reclamation Act of (SMCRA) provides that, as a prerequisite for obtaining a coal mining permit, an applicant must post a reclamation bond to ensure that the regulatory authority has sufficient funds to reclaim the site in the case the permittee fails to complete the approved reclamation plan.

Under SMCRA (c) there are several avenues for coal mining. The division is committed to balancing the need for mineral resource production with protection of the public, environment and Colorado’s natural resources. Our Mission To protect the public, miners and the environment during current mining operations, restore abandoned mines, and to ensure that all mined land is reclaimed to beneficial use.

The Forest Practices Board, an independent state agency, adopts forest practices rules, which establish standards for timber harvesting, pre-commercial thinning, road construction, fertilization, forest chemical application and other forest practices applications (Title WAC).The rules give direction on how to implement the Forest Practices Act (chapter RCW) and Stewardship of Non.

Attorneys in our group have practiced environmental law since the early s, meaning they witnessed the establishment of the Environmental Protection Agency (EPA) and the passage of the National Environmental Policy Act (NEPA), the Clean Air Act, the Clean Water Act and the Surface Mining Control and Reclamation Act.

The Surface Mining Control and Reclamation Act (SMCRA) of created a framework for a national regulatory program to prevent significant environmental damage from surface coal mining.

Inexisting mining laws were changed and new laws were promulgated to improve the safety of the underground coal miner. Mining Law, unit two of the Underground Mine Foreman Training Program, has been revised accordingly.

Mining Law now consists of part one and part two (revised February ). Unit 1 – Pre-shift Substance Abuse. Part Two discusses the State Surface Mining and Reclamation Act ofor SMARA.

Chapter 3 discusses SMARA’s functions and the agencies responsible for enforcement. Chapter 4 addresses the Act’s mineral conservation provisions, describing California’s scheme for identifying and conserving significant mineral resources. House of Representatives, One Hundred fourteenth Congress, first session, Wednesday, One of the purposes of SMCRA is to “establish a nationwide program to protect society and the environment from the adverse effects of surface coal mining operations.” Section (d) of SMCRA requires State abandoned mine land reclamation programs to be in compliance with the procedures, guidelines, and requirements established under SMCRA.

The fund consists of amounts collected through reclamation fees and other amounts. Thus, sincereclamation of surface-mined land for coal is initially the responsibility of the Office of Surface Mining within the US Department of the Interior, but individual states are allowed to take this over where they develop state programmes that comply with the procedures in the Surface Mining Act and enforce permanent standards.Coal mining is the process of extracting coal from the ground.

Coal is valued for its energy content and since the s, has been widely used to generate electricity. Steel and cement industries use coal as a fuel for extraction of iron from iron ore and for cement production. In the United Kingdom and South Africa, a coal mine and its structures are a colliery, a coal mine is a pit, and [email protected]{osti_, title = {Technical evaluation of topsoil substitution practices and handling of potential acid/toxic-forming materials in Texas.
